Just to claify something.
I spoken to the head commisioner of wv dmv office. He told me that it would be cleared off. He told me that it will still show up on my crimnal record but not on my driving record. When something is expunged it means removed. If it still showed up on my recored it wouldnt be expunged. I just got the papers here today, and it says the same as what the commisioner told me. I don't see why they would lie, when they have no reason to lie to me. Plus. I've found forums of people that who has went through it and talked to some people. For the dude talking about OJ that has nothing to do with this post so its not right for you to change the topic. Thank You.

Re: WOOT Baby WOOT...
You found a loop hole instead of taking responsibility. OJ Simpson needs your help.   [/quote]
Read the forum before you post it said 2 important things in it. Dont post here if your going to be ignorant. Take rosponsiblity for something that I didn't do. Ok.. I don't know where you was raised, but where I'm from we was taught to have some manners. You need to read the rules of these forums before you post. OJ might be guilty, but that gives you know right to post in my forums with insinuating that I'am .. I don't have to lie to know one. I take full responsiblitly for my actions. Don't judge people, when you know nothing about them. I would send a pm to the adminstrators, but i dont have enough post do do so.

I would send a pm to the adminstrators, but i dont have enough post do do so. Also, while your DMV record may be clean or "expunged", the same companies who check you DMV/MVR also check your criminal background. So they will catch this sooner or later. You might as well not even bother to try and drive for a living. They WILL find it one way or the owther. When you are in orientation they will ask you, Have you EVER been arrested or convicted of DUI? Now, they already know the answer, and if you say no, you get sent home at your own expense.

Simple rules to avoid these kinds of problems:
1. Never let anyone else touch the keys to your car. 2. If someone else needs a car, tell them to get one somewhere else. 3. If you are at any kind of function where there is "alcohol" being consumed.....go there by taxicab, or have a designated driver. 4. Never have possession of a set of keys to a vehicle if you are consuming alcohol. 5. When in doubt, read rules 1 thru 4 again, and again, and again. While I can sympathize with this persons plight, I can tell you that had it happened to me....I would have beat the rap in less than a week. Its not that hard to do. For instance.... if the cop was "antagonistic" or was a problem....a change of venue to a different court would have taken care of the issue. Then attacking that particular cop's "credibility" would been next on the list, followed by the testimony of the party that drove the car last. Oh, and I wouldn't have hired crappy lawyers. I do hope you get a job. If you end up in a truck....thats up to you. Don't bash those of us that have a problem with DUI's operating CMV's. We spend significant time trying to defend ourselves every time some fool gets loaded on alcohol or drugs and does something stupid like killing a family of 5 on the road.... This is not a career field that makes any allowance for use or possession of alcohol or drugs. I would venture to say that while some of the posters may have seemed to have been attacking you personally, I don't really think they were. Its more of a generic thing.....where they were making the posts so that others could see where "not to go". Do not take anything I have said personally.... I don't know you. You don't know me. So there is nothing that can be said personally. I can tell you this.... When I am home on my time off, if I even think about having a glass of wine, or a drink.....I have no keys in my pocket, I will not drive, my wife does the driving or someone else. The keys are never left in the vehicle, period. Before I leave to go on the road, I do not have any alcohol for a period of 18 or more hours, usually 24 hours. While I am on the road, no alcohol is consumed, period. No alcohol is ever in my truck...its an illegal substance, period. Let what you have experienced here be a "learning experience".

well.
I take nothing personal, I just dont take insults. I believe people that get DUI needs to punish too. But you can not set there and say you would have the charge beat within a week until your there. It's not as easy as you think it is. Very hard to be a cop's statement, that when he got the job he was sworn into upholding the law and given a lie ditector test. Ive been going to church for a little over 5 years now. The courts don't aknowledge that all the time though they dont take the time study the source. They would rather believe someone that they believe is justified by the law. In which, that doesnt mean that person hasnt lied or doesn't lie now. Anyways, I've talked to the DMV.
They say in the state of WV, DUI Under 21, with a BAC level beneath 0.79. Can be removed from your record with no traces. In which my BAC Level was under .40 . Once completed the interlock program they ask of you to go to the dmv for record printout of your dmv record which shows it not there. After that they will write a letter to the courts telling them that they are removing the DUI from there records, because the person successfully completed Alcohol and Drug Rehabilition Classes & Interlock Program for 6 months in which he has done. Then what you do is call the court house and talk to them and tell them what you have done and then they can take it out of there records.
