rest areas and no overnight stay laws

Default rest areas and no overnight stay laws

Does anyone know if they enforce this law in North Carolina? Just curious...

I try to drive at night as much as I can and every NC rest area I see with that sign is full in the middle of the night.

Virginia has the same law. I've stayed overnight before with no problem but I have heard of others getting tickets.

Here in NM, the only rest area parking regulation is that you're not allowed to be there for more than 24 hours.

Over the years... I have "routinely" stayed "overnight" in NC and VA rest areas....and I have never been given a ticket...or even spoken to by a LEO.

At one time VA used to be a little pissy about it....some rest areas had a two hour limit :shock: ....but with the advent of the new HOS, and the many complaints issued by drivers....that problem seems to have righted itself.

I think that they might be more inclined to enforce that rule on someone in a car....or someone acting suspiciously.

Not to worry about it.

Just stay out of the VA rest area just North of the NC line on I-95....trucks are NOT ALLOWED in it. It was built for cars and RV's only....

The only time I've seen a cop give anyone a problem in VA is when they're parked on the ramp. If you're actually parked IN the rest area you should be fine.

Hey Sky, same with the one on 64 East just inside the VA line. Cars only, Truck only rest stop is something like 15 miles further in.

Are they not pissy about it anymore? I've been in a VA rest area where I had to beg the resident cop to look the other way and let me catch another hour of nap before shoving me out, but that was awhile ago. The rest areas have always been full after dusk, with a hundred people parked by the NO PARKING signs, but I've also heard hundreds or thousands of accounts of people getting tickets for breaking the two hour rule, and the tickets were listed a "failure to obey a highway sign," which was a moving violation, and carried points.

Personally, I have never spent the night in a rest area in any state ever.

This is why I like staying out west. the only short term I know about is on I-5 in Everett, wa. the rest are mostly 8 hour ones and no one seems to push that unless there are complaints.

I routinely stay in rest areas all over the eastern half of the country. Not once have I been woken up by a LEO. But, like I said before, I have woken up and seen LEO's knocking on truck doors who are parked in the no parking areas. The last time I saw it, I was parked in the car side of the rest area. He did his thing with those other drivers and was on his way.
