If he paid off the truck before Arrow borrowed money on it then he should be able to get a clear title. If he received a title that did not have a lien on it then I don't see that there should be a problem with him getting a clear title in his name. This is blatant fraud against him and Daimler Chrysler. I think that in this case he should prevail. At least I hope that he will. Arrow could not legally borrow money on a truck that they no longer own. Hopefully, he has kept all of his receipts. The fact that he did receive a signed and notarized statement and title from Arrow should be enough to get his title. On the other hand, if the loan was made to Arrow to initially purchase the truck then it could be a problem. I am glad that he plans on pursuing this through the courts. He could file a suite against Daimler Chrysler along with Arrow to get his title.

We all know that these LP deals can be a major rip off and this just goes to show how true it is. I never really had an opinion about Arrow one way or another, but after how they left their drivers stranded all over the country and all of these allegations of wrong doing, my opinion is rapidly leaning towards them being real low lifes. :thumbsdown:
I really hope that this LP driver (and anyone else) can get this sorted out (in his favor) real soon.

I think that his case for possession will depend on when Arrow borrowed money on the truck. If it was debt free or if Arrow borrowed money from Daimler Chrysler on the truck after he paid it off then he should be able to gain title without too much hassle. I think that if the money was borrowed to initially purchase the truck that he and others may be left out of luck. Of course, in bankruptcy anything can happen. There is a lot to be sorted out in this case. Each creditor has a right to be heard. With 1,000-5,000 potential creditors the actual meeting of creditors could take some time. The court could order all assets to be sold at auction or by other means and the proceeds distributed to the creditors according to their claim. It is a drama that continues to unfold. I believe this guy has filed criminal charges against Arrow. The authorities are now trying to decide who has jurisdiction. Once that is decided then we could see things move a bit more briskly.

I dont think that criminal charges will do much for these people who lost their trucks. After everything is settled people who did the crime will be held liable by many others including the TAB. After they get their money whatever is left will go out to others, whatever that might be.
There will be no money left to satisfy everyone and only way Arrow can pay its debt is by jail time for those who are responsible but it will not do any good for the drivers. |
